Komnas HAM: Involvement of BAIS TNI to BNPT in TWK KPK Illegal

ACCURATE.CO Komnas HAM stated that the involvement of the Army Psychology Service, BAIS TNI, BIN, BNPT, and the Army Intelligence Center in the KPK’s National Insight Test (TWK) assessment process was illegal. The involvement of third parties in the process of transferring the status of KPK employees does not have a clear legal basis.

Therefore, Komnas HAM concluded that the whole process was illegal.

“The involvement of the Army Psychology Service, BAIS, BIN, BNPT in this process (TWK) including the Army Intelligence Center has no real legal basis,” Komnas HAM Commissioner Choirul Anam said in a virtual discussion held by YLBHI, Jakarta, Sunday (29 /8/2021).

Because there is no legal basis or legal reference in working with these parties, the entire KPK TWK process is illegal. Because, in the technical implementation, all stages are carried out by the third party.

“Because this process does not have a legal reference, we declare the entire process illegal. It can’t. That’s a serious problem. So we state because this has no legal basis. It is not based on law,” he said.

Previously, Komnas HAM Commissioner Choirul Anam again revealed how the preparation process for the National Insight Test (TWK) assessment for KPK employees took place.

He revealed that the term “selection” which replaced the term “transfer of status” appeared in the final seconds of the discussion on the transfer of the status of KPK employees as directed by President Joko Widodo.

“Even when talking about the word “selection” it appears at the end (of the process). Not at the beginning of the process. In the middle of the process. No. But really at the end (of the process). It’s like acrobatics, you see,” he said in a virtual discussion organized by YLBHI, Jakarta, Sunday (29/8/2021).

He revealed that on May 25, 2021, the KPK leadership held a meeting with the leaders of other institutions related to the implementation of the status transfer. The meeting was held as part of the follow-up to President Jokowi’s directives.
