1NEWS, The Corruption Eradication Commission (KPK) received fresh air with the decision of the Constitutional Court (MK) which stated that the process of transferring the status of KPK employees through the National Insight Test (TWK) did not conflict with the 1945 Constitution and emphasized that the KPK obeyed the rules.
With the Constitutional Court’s decision, the KPK stated that the process of changing the status of KPK employees to ASN was in accordance with the constitution.
“The Constitutional Court’s decision confirms that the KPK has carried out the process of transferring the status of KPK employees to ASN in accordance with applicable rules and regulations which involve competent and competent parties,” said Acting KPK Spokesperson Ali Fikri in Jakarta, Wednesday (1/9). /2021).
Ali Fikri stated that the KPK has consistently respected the results of examinations and decisions related to the process of transferring the status of KPK employees to ASN from institutions according to their authority. Both the results of the examination which ‘output’ recommendations as well as judicial decisions that are binding and force the parties to follow up.

In the judicial review decision Number 34/PUU-XIX/2021, the Constitutional Court stated that Article 69B paragraph (1) and Article 69C of Law 19/2019 concerning the KPK applies not only to KPK employees who do not pass the TWK but also to all KPK employees so that they are not discriminatory. The fact that there are several KPK employees who do not pass the TWK is not a matter of the constitutionality of norms.
The Constitutional Court considers the fact that certain special conditions are given for certain jobs, is not interpreted as an attempt to eliminate a person’s right to work and receive fair and proper remuneration and treatment in an employment relationship.
The material test arose because of the TWK implementation at the KPK which took place in March-April 2021, which was attended by 1,351 employees. However, there are only 1,271 people who have passed and have been appointed as ASN.
